Sunday Streams Terms of Service
The following Terms of Service is an agreement between Netformz, Inc. (hereto referred to as "SundayStreams.com,” "Sunday Streams,” "us,” "we” and "our") and the client (hereto referred to as "you,” "your” and "clients"), who must be at least 18 years of age and is using or has used our 30-day free trial or is a paying client, and viewers who utilize the services provided by SundayStreams.com. By utilizing our site and our services, you agree to be bound by the Terms of Service set forth herein. If you agree to these Terms of Service on behalf of a business or religious institution, you represent and warrant that you have the authority to bind that entity to these Terms of Service. Our Terms of Service is located at http://www.sundaystreams.com/terms-of-service.shtml. We reserve the right to update the Terms of Service, and the updated version shall take precedence over previous versions.
- You are solely responsible for the content broadcasted on your Sunday Streams account, and you agree that Sunday Streams is merely providing you with the way to broadcast and archive your content. Sunday Streams does not own your live or archived streamed content. You agree that our services are to be used for lawful purposes only and that you are responsible for any violations of all applicable local, state, national and foreign laws.
- You are responsible for keeping sensitive information secure, which includes the password we provide to login to the Sunday Streams Manager as well as your FMS URL, which is found in the Sunday Streams Manager. In the event your password or account has been compromised, you are responsible for notifying SundayStreams.com immediately and reporting any unauthorized use of your account.
- At our sole discretion, and for any reason, and without penalty, we reserve the right to suspend or terminate any account or any part of any account at any time. We reserve the right to discard any or part of any content on our server without notice, which may include your archived broadcasts.
- As a client of Sunday Streams using our services after your 30-day free trial period, you agree to pay a monthly fee or prepaid amount for services offered in your Sunday Streams package. You agree to pay your monthly fee or prepaid amount in advance of receiving our service. Sunday Streams accepts major credit cards, personal and business checks and automatic payments from a bank account. If you pay with a credit card, you agree that we may charge your designated credit card for any such payments. If you opt to pay with automatic bank account withdrawals, you will need to sign a ACH Authorization Form. You are required to keep your billing information up to date and notify Sunday Streams if your credit card has been cancelled due to loss or theft. You are responsible for all charges incurred by your account.
- Moreover, Sunday Streams reserves the right to disable your account if payment is past due, regardless of the dollar amount.
- If you are dissatisfied with Sunday Streams, your only remedy is to discontinue utilizing our service. If you provide written notice of your desire to terminate your use of Sunday Streams, we will refund you on a prorated basis for any remaining time you may have prepaid for.
- If you rent a SUNS Toolkit, these terms as well as additional terms apply. Please consult your signed SUNS Toolkit renal agreement for additional terms.
- Viewers of your broadcasted and archived content are encouraged to report any violations of any laws by contacting Sunday Streams at http://www.sundaystreams.com/contact.shtml. Viewers and clients are aware that Sunday Streams does not endorse any opinion or advice offered in content uploaded, broadcasted and archived by clients. It is the viewer’s responsibility to use discretion when evaluating the validity of the information broadcasted by clients who use our services. Sunday Streams expressly disclaims any and all liability in connection with the content broadcast by clients who utilize our services.
- YOU AGREE THAT YOU WILL NOT USE SUNDAY STREAMS AND ITS SERVICES TO BROADCAST OR ARCHIVE ANY MATERIAL THAT VIOLATES COPYRIGHTED WORKS OR ENCOURAGES THE INFRINGEMENT OF THE INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY.
- You agree that your use of Sunday Streams is at your sole discretion and risk. Our services are provided “as is” and “as available” without any warranties of any kind. Sunday Streams expressly disclaims all warranties of any kind, express or implied. In no event shall Sunday Streams or its employees, directors, or agents be held liable for any damages of any kind resulting from utilizing our services. This limitation of liability will apply to the fullest extent permitted by law.
- IN NO WAY WILL SUNDAY STREAMS, ITS EMPLOYEES, DIRECTORS, OR AGENTS, BE LIABLE TO YOU FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF SUNDAY STREAMS SERVICES AND CONTENT WHETHER THE DAMAGES ARE FORESEEABLE AND WHETHER OR NOT SUNDAY STREAMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION AND IN NO EVENT WILL SUNDAY STREAMS CUMULATIVE LIABILITY TO YOU EXCEED $100.
- These Terms of Service shall be governed by and construed under the laws of Florida.
